OVERVIEW

Welcome to DecorusOne.

The terms “DecorusOne”, “we”, “us” and “our” refer to DecorusOne, trading as DecorusOne.

DecorusOne operates this online store and website, including its related information, content, features, tools, products and services, collectively referred to as the “Services”.

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you. Purchases made through this store are transactions between you and DecorusOne.

These Terms of Service, together with our Privacy Policy, Shipping Policy, Returns and Refunds Policy, Warranty Policy and any other policies referenced in these Terms, explain your rights and responsibilities when you use the Services.

Please read these Terms carefully. They contain important information about orders, payments, international delivery, returns, warranties, consumer rights, intellectual property and limitations of liability.

By accessing or using the Services, creating an account or placing an order, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree with these Terms, you should not use the Services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or another applicable consumer-protection law.

SECTION 1: ELIGIBILITY, ACCESS AND ACCOUNTS

You must have the legal capacity to enter into a binding agreement in your jurisdiction to place an order through DecorusOne.

If you allow another person to use the Services through your device or account, you are responsible for supervising that use where permitted by law.

When using the Services, you may be asked to provide information including your name, email address, billing address, delivery address, telephone number and payment information.

You agree that information you provide will be accurate, current and complete and that you have the authority to provide it.

If customer accounts are enabled, you are responsible for:

  • maintaining the confidentiality of your login credentials;
  • restricting unauthorised access to your account;
  • reviewing account activity; and
  • contacting us promptly if you suspect unauthorised use.

You must not sell, transfer, assign or license your customer account to another person.

We may suspend or restrict access to an account where reasonably necessary to protect the customer, DecorusOne, Shopify, our service providers or other users from suspected fraud, misuse or unlawful activity.

SECTION 2: PRODUCT INFORMATION

We take reasonable steps to present product information accurately. However, colours, textures, dimensions and product appearance may vary depending on your screen, device settings, lighting, photography and manufacturing tolerances.

Product dimensions, weights and measurements are generally approximate unless expressly stated otherwise.

Product images may include accessories, styling items or background objects that are not included with the product. The product description and package-contents information should be reviewed before placing an order.

Some product information is supplied by manufacturers, suppliers or fulfilment partners. We may correct or update product information when inaccuracies are identified.

We do not guarantee that every product will meet personal preferences or subjective expectations. This does not limit any rights relating to products that are faulty, unsafe, materially different from their description or otherwise fail to meet applicable consumer guarantees.

We may modify, replace or discontinue products, variations or collections at any time. Product availability is subject to supplier stock and may change without notice.

SECTION 3: PRODUCT AVAILABILITY AND INTERNATIONAL ELIGIBILITY

The presence of a product on the website does not guarantee that it is available, in stock or deliverable to every destination.

International delivery is available only for eligible products to selected destinations.

A product identified as an “International Option”, included in our International Collection or associated with an internal supplier reference does not guarantee delivery to every country.

International eligibility may depend on:

  • the product and product category;
  • package dimensions and weight;
  • supplier stock;
  • carrier availability;
  • delivery location;
  • local laws and import restrictions;
  • customs requirements;
  • battery, electrical or dangerous-goods restrictions; and
  • the shipping rates configured at checkout.

Final delivery availability and applicable shipping charges are confirmed during checkout or during our order-verification process.

SECTION 4: ORDERS AND ACCEPTANCE

When you submit an order, you are offering to purchase the products in that order subject to these Terms.

An automated order acknowledgement confirms that we received your order. It does not necessarily mean that we have accepted the order.

An order is accepted when we confirm acceptance, begin fulfilment or dispatch the product, depending on the circumstances.

We may decline, place on hold or cancel an order where reasonably necessary, including where:

  • the product is unavailable;
  • the supplier cannot fulfil the order;
  • the delivery location is unsupported;
  • the displayed price or product information contains a material error;
  • payment is unsuccessful or reversed;
  • fraud or unauthorised activity is suspected;
  • the order appears to be intended for unauthorised resale;
  • a product cannot lawfully be supplied or imported; or
  • fulfilment would breach a legal or regulatory requirement.

If we cancel an order after payment has been received, we will arrange a refund to the original payment method, subject to payment-provider processing times.

We will attempt to notify you using the email address, telephone number or billing information provided with the order.

SECTION 5: ORDER CHANGES AND CANCELLATIONS

Please review your products, quantities, variations, delivery address and contact information carefully before submitting an order.

If you need to request a change or cancellation, contact support@decorusone.com as soon as possible.

We cannot guarantee that an order can be changed or cancelled after it has been submitted. Orders may be transmitted to a supplier or fulfilment partner shortly after payment.

Once processing or dispatch has commenced, cancellation or address changes may no longer be possible.

Refusing delivery or failing to collect a parcel does not automatically create an entitlement to a full refund. Applicable delivery, return-to-sender, customs and return costs may be deducted where legally permitted.

Nothing in this section limits rights that cannot lawfully be excluded under applicable consumer law.

SECTION 6: PERSONAL AND COMMERCIAL USE

Unless otherwise agreed in writing, products offered through DecorusOne are intended for personal or household use.

You must not purchase products for unauthorised resale, unlawful export, sanctions evasion or another prohibited commercial purpose.

We may limit quantities, request additional information or decline an order that appears inconsistent with ordinary personal or household use.

SECTION 7: PRICES, CURRENCIES AND PROMOTIONS

Prices, discounts, offers and promotions may change without notice.

The amount payable is the amount displayed and confirmed during checkout, subject to correction of an obvious pricing or technical error.

Depending on your market and Shopify configuration, prices may be displayed in AUD or another supported currency.

Your bank, card issuer or payment provider may apply:

  • foreign-exchange conversions;
  • international transaction fees;
  • payment-processing charges; or
  • other account charges.

These third-party charges are not controlled by DecorusOne.

Unless checkout expressly states otherwise, displayed product prices may exclude:

  • delivery charges;
  • customs duties;
  • import taxes;
  • brokerage fees; and
  • other destination-country charges.

Promotional offers may be governed by additional conditions, including eligibility, minimum order value, geographic availability, applicable products, exclusions and expiry dates.

If specific promotion terms conflict with these Terms, the specific promotion terms apply to that promotion to the extent of the conflict.

SECTION 8: PAYMENT AND BILLING

You agree to provide accurate and complete billing, payment and contact information.

You represent that you are authorised to use the payment method submitted with your order.

Payments may be processed by Shopify Payments, PayPal or other authorised payment providers displayed during checkout.

Payment providers may perform fraud, identity, sanctions or transaction checks. They may decline or delay a transaction under their own terms and policies.

DecorusOne does not ordinarily receive or store complete payment-card numbers.

If a payment is reversed, charged back or found to be unauthorised, we may suspend fulfilment, cancel the order or take reasonable steps to recover an amount lawfully owed.

SECTION 9: SHIPPING AND DELIVERY

Delivery is available only for eligible products to supported destinations.

Processing time and carrier transit time are separate. All dispatch and delivery timeframes are estimates and are not guaranteed.

Products may be dispatched by approved suppliers or fulfilment partners and may originate from different locations.

An order containing multiple products may be:

  • processed by different fulfilment locations;
  • dispatched in separate parcels;
  • assigned more than one tracking number; and
  • delivered on different dates.

Shipping charges depend on the product, parcel size, parcel weight, order value, carrier and destination. The applicable charge is normally displayed during checkout.

Any free-shipping promotion applies only under the conditions stated in the promotion, product page or checkout. If checkout displays a shipping charge, the order does not qualify for free shipping.

Delivery estimates may be affected by:

  • supplier processing;
  • carrier delays;
  • weather or natural events;
  • remote-area delivery conditions;
  • public holidays;
  • customs processing;
  • incorrect or incomplete addresses;
  • security, regulatory or border inspections; or
  • other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional charges arising from an incorrect, incomplete or inaccessible address may be payable by you where permitted by law.

Risk of loss or damage does not pass to you earlier than permitted by applicable consumer law. Nothing in these Terms removes DecorusOne’s responsibility to assist with products lost or damaged in transit where the law places that responsibility on us.

SECTION 10: INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES

International orders may be subject to customs duties, import taxes, brokerage fees, handling charges or other charges imposed by the destination country.

Unless checkout expressly states that these charges have been collected, you may be responsible for paying them.

DecorusOne does not control customs assessments, customs processing times or changes to destination-country import requirements.

You are responsible for checking whether a product can lawfully be imported, possessed or used in your destination before ordering.

If an order is refused, abandoned or returned because applicable customs charges were not paid, the order may be handled under our refused-delivery or change-of-mind return conditions, subject to applicable law.

Original delivery charges, return-to-sender charges and customs charges may not be refundable in these circumstances where legally permitted.

SECTION 11: RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, replacements and exchanges are governed by our Returns and Refunds Policy.

You must contact support@decorusone.com before returning a product.

Products may need to be returned to different approved locations. Do not return a product to our business address, the parcel sender’s address or another address unless we have provided that address in written return instructions.

Nothing in our returns process excludes or limits a statutory right or remedy that cannot lawfully be excluded.

SECTION 12: CONSUMER GUARANTEES AND WARRANTIES

Products sold to Australian consumers come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, applicable consumer rights may include a repair, replacement, refund or other remedy.

International customers may also have mandatory rights under the consumer-protection laws applying in their jurisdiction.

Any supplier or manufacturer warranty is additional to mandatory consumer rights and does not replace or restrict those rights.

Unless a different period is stated on the relevant product page, certain eligible products may include a supplier or manufacturer warranty of up to 12 months. Product-specific terms and exclusions may apply.

SECTION 13: PRODUCT SAFETY AND USE

You are responsible for reading and following all product instructions, warnings, assembly requirements, age recommendations, care information and safety notices.

Products must be used only for their intended purpose.

Stop using a product immediately if it appears damaged, defective, unsafe or subject to a safety notice.

Contact support@decorusone.com if you identify a product-safety concern.

Some electrical, battery-powered, children’s, fitness, pet, health or regulated products may have destination-specific restrictions or requirements.

SECTION 14: INTELLECTUAL PROPERTY

The Services and their content, including trademarks, logos, branding, text, graphics, photographs, product layouts, video, audio, website design and original content, are owned by or licensed to DecorusOne, Shopify or their respective owners.

Content may be protected by copyright, trademark and other intellectual-property laws in Australia and other countries.

Subject to these Terms, you may access and use the Services for personal and lawful purposes.

Without prior written authorisation, you must not:

  • copy, reproduce, distribute or republish protected content;
  • modify or create derivative works from protected content;
  • use our branding or trademarks;
  • remove copyright, trademark or ownership notices;
  • use content to create a competing product catalogue or service; or
  • use the Services in a way that infringes another person’s rights.

Shopify’s name, logo and related marks belong to Shopify. Other product names, brands and marks belong to their respective owners.

SECTION 15: OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may provide access to tools, applications, payment methods, social-media functions or other features provided by third parties.

Your use of a third-party service may be governed by the provider’s own terms and privacy policy.

We do not control every third-party service and are not responsible for matters outside our reasonable control. This does not limit any responsibility that cannot lawfully be excluded.

We may introduce, change or discontinue optional features at any time.

SECTION 16: THIRD-PARTY LINKS

The Services may include links to websites and platforms operated by third parties.

DecorusOne does not control and does not necessarily endorse third-party websites.

Before using a third-party website or completing a transaction with another business, review the third party’s terms, privacy policy and business practices.

Questions or complaints concerning an independent third-party transaction should be directed to that third party. This does not affect our responsibility for purchases made directly from DecorusOne.

SECTION 17: RELATIONSHIP WITH SHOPIFY

DecorusOne is powered by Shopify, which enables us to provide the Services.

Purchases made through our store are transactions directly between you and DecorusOne. Shopify is not the seller of products purchased from DecorusOne.

To the extent permitted by applicable law, Shopify is not responsible for the performance, quality, delivery, safety, return or warranty of products sold by DecorusOne.

Nothing in this section limits rights that cannot lawfully be excluded.

SECTION 18: PRIVACY

Our collection, use, storage and disclosure of personal information is governed by the DecorusOne Privacy Policy.

Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information relating to your use of the Services.

SECTION 32: CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our Services, business operations, technology or legal obligations.

The current version will be displayed on this page with the updated effective date.

Where required by applicable law, we will provide additional notice of material changes.

Changes will not retrospectively reduce rights relating to an order already accepted unless permitted by law.
